Exxxotica, the sex expo banned from the convention center in Dallas.

The Dallas City Council banned the porn expo in February and two months later, the United States District Judge Sidney Fitzwater denied the its request to throw out the ordinance keeping it out in the cold.

The judge ruled that the Kay Bailey Hutchison Convention Center wasn't a "quintessential public forum" open to anyone. But Fitzwater's ruling came with a caveat, If Exxxotica could prove him wrong, it could re-argue the case.

Exxxotica's attorney, Dallas' Roger Albright, said that, Exxxotica believes it has "proven the convention center is a designated public forum, which the municipality has made available as a forum to any and all groups, viewpoints, content, etc. "

According to court documents, the convention center has, in the past, "been used by persons and groups for various protests and rallies, including a rally in support of legalizing marijuana, pro life rallies, protests against Ayatollah Ruhollah Khomeini, killing endangered animals, and the Ferguson, Missouri shooting, and an Occupy Dallas protest."
